What does this Privacy Policy cover?

This Privacy Policy covers information about Personal Information we collected from you, the reasons why we collected your Personal Information, how we obtained your Personal Information we collected, and the third parties with whom we may share your Personal Information.

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services, but does not cover the practices of companies we don’t own or control, or people that we don’t manage. We gather various types of Personal Information, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our products and services, develop new products and services, to allow you to set up a user account and profile, to contact you and allow others to contact you, to fulfill your requests for certain products and services, to analyze how you use the Services, and for other business purposes. In certain cases, we may also share some Personal Information with third parties, but only as described below.

Will Zume ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Services, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them.

What Personal Information does Zume collect?

When you use our Services, we may collect or receive Personal Information about you to provide our Services and operate our business. The types of Personal Information that we may collect about you are:

 

Information You Provide to Us

We collect and maintain personal information that you provide to us when you use our Services or otherwise interact with you. Such interactions include when you register for an account, complete electronic forms, place and order, search within our Services, change your account settings, communicate with Zume employees/agents or contact us by online chat, online form submission, email, phone or text. The Personal Information we collect may include, for example: your name, email address, phone number, delivery address, and other contact information; your account credentials and profile information; information related to your order (items purchased, special instructions, date and time of order, subtotal, etc.); the content and other details of your communication with us; the purpose of the interaction, and the action we took in response to your inquiry or request.

If you sign in to the Services through a third party site or service such as Facebook, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us. For example, if you log into your account using your Facebook credentials then we will receive information from your Facebook profile such as your user name, email address, list of friends, and other information you allow Facebook to share with services you sign into.

Certain information is required by us to register you or allow you to take advantage of some of our features.


Information Collected Automatically
Whenever you interact with our Services from a mobile device or computer, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, information related to operating system, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested.

Also, the email we send may contain an electronic image (sometimes called a web beacon or single-pixel GIF) that allows us to receive a confirmation when you open the email. This confirmation helps us make our communications with you more interesting and improve our services.


Your Location Information
When you use the Services, you may opt in to share your location with us. You can choose to enable the location tracking feature through the settings on your device or through the mobile application(s). This information may be used to help you select your delivery address, to provide more accurate deliveries of your orders, to provide recommendations to you, and to enhance your user experience and improve the Services. If you choose not to enable the location feature, our Services will not receive location information from your device, unless your otherwise provide us that information directly.


Information from Publicly Available Sources and Third parties
We may collect or receive Personal Information about you from publicly available sources, marketing partners, social network providers, and/or third parties. This information may include demographic data such as marital status, income, and other household information.

 

How Will Zume Use Your Personal Information?

We may use the information we collect from you or receive about you for various purposes.


To Provide You With Our Services
We may use your information to provide you the Services. For example, we use deliver address you provided to fulfill your delivery. If the applicable information is to be provided or Service is to be performed by a third party, then we will disclose the applicable Personal Information to the third party providing the information or performing applicable Services. To Maintain Safety and Security
We may use your information to prevent, detect, and combat fraud and unsafe activities, and/or to monitor and verify your identity so that unauthorized users do not gain access to your information.


To Comply with Applicable Laws, Legal Processes or Regulations
We may use your information to investigate or address claims or issues related to the use of our Services, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.


To Protect You, Others, and Our Business
We may use your information to protect you, others, and our business, including, without limitation, using information for fraud prevention, for enforcement of our Terms of Service, to comply with the law, and to protect against security risks.


For Other Business Purposes

Will Zume Share Any of the Personal Information it Receives?

We do not rent or sell your Personal Information in personally identifiable form to anyone, except as expressly provided below. We may share your Personal Information with third parties to provide the Services to you through our website and mobile application(s):


De-Identified Data
We may de-identify your Personal Information so that you are not identified as an individual, and provide that de-identified information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our and their Services, so that they, too, can provide you with an optimal online experience.


Partner Services

Because the California Consumer Privacy Act (CCPA) defines “sell” and “personal information” very broadly, our use of advertising and analytics providers on our websites and apps, which allows those providers to collect information such as IP addresses, cookie IDs, and mobile IDs, may be considered a “sale” of personal information under those definitions.

We may use third party analytics and advertising services, such as Google Analytics and the Google Analytics Remarketing and Advertising Reporting Feature, to grow our business, to improve and develop our Services, to monitor and analyze use of our Services, to aid our technical administration, to increase the functionality and user-friendliness of our Services, to verify that users have the authorization needed for us to process their requests, and to advertise online.

These third-party services collect and retain information about you associated with mobile advertising identifiers and/or cookie identifiers. Because these third parties provide these services to many companies, they can compile information about your online activities over time and across different websites. Personal Information Shared with Affiliated Businesses

In certain situations, businesses or third-party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information (in personally identifiable form) with that affiliated business only to the extent that it is related to such transaction or service. Personal Information Shared with Our Agents

We use other companies and third-party service providers (including affiliates, contractors, vendors, partners, and/or suppliers) (“Agents”) to perform tasks on our behalf and need to share your Personal Information (in personally identifiable form) with them to provide Services to you, and to improve our Services. For example, we may use a payment processing company to receive and process your credit card transactions for us. When you make a purchase through our Services, our payments processor will process that payment and we will never have direct access to your credit card information. Personal Information Shared in User Profiles and Submissions:

In some Zume Services, certain Personal Information (in personally identifiable form) contained in your user profile information, including your name, location, and any video or image content you have uploaded to the Services, may be displayed to other users to facilitate user interaction within the Services or address your request for our Services. Your account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to a public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your user name may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments. Additionally, if you sign into the Services through a third party social networking site or service, your list of “friends” from that site or service may be automatically imported to the Services, and such “friends,” if they are also registered users of the Services, may be able to access certain non-public information you have entered in your Services user profile. Again, we do not control the policies and practices of any other third-party site or service.

 
Personal Information Shared in Connection with Business Transfers

We may choose to buy or sell assets and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Is Personal Information about me secure?

Your account is protected by a password for your privacy and security. If you access your account via a third-party site or service, you may have additional or different sign-on protections via that third-party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

What Personal Information can I access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

What choices do I have?

You can always choose not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features. You can access, edit, or delete personal information as described above. You can also use the controls regarding analytics and online advertising described in the Partner Services section above.

You can control the use of cookies by using your browser settings to delete or reject cookies. Note that If you choose to delete or reject cookies, this could affect certain features or services of our websites. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated. iOS and Android operating systems similarly provide options to limit tracking and/or reset the advertising IDs.

Your browser may offer you a “Do Not Track” option, which allows you to signal to websites and web applications and services (including behavioral advertising services) that you do not wish to be tracked. Because there is not a common understanding of how to interpret the Do Not Track signal, our Services do not support Do Not Track requests at this time. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described below.

If you are a California resident and the processing of personal information about you is subject to the California Consumer Privacy Act (“CCPA”), you have certain rights with respect to that information. Your rights explained below are not absolute and are subject to certain exceptions.

  1. Right to Know – You have the right to know and access the Personal Information we collect, use, disclose, and sell about you. If you have a Services account, you may add, update or edit certain Personal Information by logging into our Services on our site or mobile application(s) using your username and password and visiting the “Account” page. You can access your order history information through the capabilities of Zume mobile application(s).
  2. Right to Request Deletion – You have the right to request that we delete any Personal Information we have collected from you or have about you under certain circumstances. We may save Personal Information when permitted by applicable law(s).
  3. Right to Opt-Out of the Sale of Your Personal Information – You have the right to opt-out of having your Personal Information sold. Note that the CCPA defines “sell” and “personal information” very broadly, and some of our data sharing described in this Privacy Policy may be considered a “sale” under those definitions. In order to fulfill your request to know or request to delete, we will need to verify your identity. We may deny requests from users whose identity cannot be verified. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on their behalf. We may deny requests from users whose identity cannot be verified.
